How we estimate this

  • USPTO fees are the 2026 published amounts: $350 per class to file, $200 per class if you write your own identification of goods, $150 per class for a statement of use and $125 per class for each six month extension.
  • Maintenance is budgeted at about $975 per class across the first decade, covering the declaration of use in years five to six and the renewal at year ten.
  • Filing help ranges come from advertised pricing: budget services at $500 to $1,000 and experienced trademark counsel at $1,000 to $2,500 for a single class, with smaller increments for extra classes.
  • Clearance searches are priced at $500 to $1,500 for a full search with a written opinion. Free knockout searching costs nothing but catches far less.
  • Office action risk is modelled as a probability, currently about 40 percent for these inputs, applied to a response cost of $500 to $1,000 for simple refusals and $1,500 to $3,500 for complex ones.
  • We deliberately exclude litigation, opposition proceedings, foreign filings and rebranding costs. Those are real risks but they are not typical line items.

What moves the number most

  • Class count. Every class multiplies government fees, surcharges, statement of use fees and maintenance.
  • Custom wording. It costs $200 per class immediately and raises the odds of a requirement from the examining attorney.
  • Descriptiveness. Marks that describe the product draw the most expensive refusals, and no amount of cheap filing avoids that.
  • Timing. Intent to use filings are cheaper to start and more expensive to finish.
