A patent budget has stages. A provisional application can establish a filing date for adequately disclosed material, but it is not examined and does not become an issued patent on its own. A utility nonprovisional application enters examination and can involve objections, amendments and additional professional work. Comparing only the filing fee hides most of the practical cost.
This guide covers ordinary US utility applications, not design patents, international filings or patent litigation. Fees depend on entity status, filing method, claims and timing. Professional drafting is a separate budget. A founder should decide what needs protecting and how the filing supports the business before treating a provisional application as a cheap certificate that protects every future version of a product.
Government fees and professional costs
| Item | Cost | Scope |
|---|---|---|
| Provisional filing | $325 large; $130 small; $65 micro | Official base fee; eligibility must be confirmed. |
| Utility basic filing | $350 large; $140 small; $70 micro | Small entity electronic basic filing discount can reduce the basic fee to $70. |
| Utility search | $770 large; $308 small; $154 micro | Separate initial search charge. |
| Utility examination | $880 large; $352 small; $176 micro | Separate initial examination charge. |
| Utility issue | $1,290 large; $516 small; $258 micro | Payable if the application is allowed, not included in initial filing. |
| Utility maintenance at 3.5 years | $2,150 large; $860 small; $430 micro | Ordinary payment after grant, excluding late surcharges. |
| Utility maintenance at 7.5 years | $4,040 large; $1,616 small; $808 micro | Ordinary payment after grant. |
| Utility maintenance at 11.5 years | $8,280 large; $3,312 small; $1,656 micro | Ordinary payment after grant. |
| Item | Cost | Scope |
|---|---|---|
| Provisional drafting | $1,500 to $3,500 | Hypothetical relatively simple invention; complex work can cost more. |
| Utility nonprovisional drafting | $6,000 to $12,000 | Illustrative simple scope; no universal attorney tariff. |
| Patent drawings | $300 to $800 | Illustrative separate allowance if not included in drafting. |
| Examination response reserve | $1,500 to $5,000 | Hypothetical allowance for limited responses; no guarantee of allowance. |
Initial utility filing, search and examination total $2,000 for a large entity and $400 for a micro entity at the listed base rates. Small entity fees total $800 before the electronic basic filing discount, or $730 when that discounted $70 basic fee applies. Confirm eligibility and the selected filing method in Patent Center instead of assuming every startup qualifies for micro status.
The current schedule also lists a non DOCX filing surcharge of $430 large, $172 small or $86 micro for applicable utility submissions. Paper filing and extra claims can add other fees. Those are not included in our ordinary electronic examples. Entity eligibility can change during the process, so maintenance budgets should not assume a discount will apply for the entire patent term.
What the provisional actually buys
A provisional gives a route to establish an earlier filing date for material it adequately describes. It does not receive substantive examination, issue by itself or provide a substitute for a complete technical disclosure. New matter added later may not receive the earlier date. A few informal product notes can therefore be cheap to submit but weak support for the claims the business eventually wants.
The normal follow on window is 12 months. A nonprovisional claiming the provisional benefit must meet the applicable timing and requirements. Put that next stage in the budget before spending on the first filing. If the business cannot fund drafting and examination later, it should understand what expires and which strategic choices remain rather than assuming the provisional creates permanent protection.
Why drafting usually costs more than filing
Professional work includes understanding the invention, describing implementations and drafting claims. A straightforward mechanical improvement can require less work than a complex software, electronics or biotechnology invention. The scope also depends on how much technical material the founder supplies. A fee described as filing assistance may not include a search, claim strategy or a careful discussion of alternatives.
Ask what the proposal includes: inventor interviews, drawings, search work, revision rounds, the filing receipt and later examination responses. A patentability search and a freedom to operate analysis are different projects. The first looks at whether claims might be patentable; the second considers risk from others' rights in a proposed commercial activity. Do not assume 1 inexpensive search answers both questions.
Budget for examination and the years after grant
Examination can produce office actions requiring clarification, amendment or argument. The number and difficulty are not known when the application is first drafted. Our response reserve is a hypothetical planning line, not an invented probability of rejection. If a response quote arrives, ask which issues are addressed and whether interviews, amendments and further submissions are included.
Allowance creates an issue fee, not the end of the budget. Ordinary US utility patents have maintenance payments at 3.5, 7.5 and 11.5 years after grant. The listed micro amounts sum to $2,894 at unchanged rates, while small entity amounts sum to $5,788. Those totals exclude late charges and any status change. Keep reminders and ownership records current so an administrative lapse does not undermine the asset.
Choose a filing plan around the business
A founder should consider product life, ability to detect infringement and the likely value of exclusivity before spending heavily. A patent application does not guarantee a broad enforceable patent, and a granted patent does not guarantee commercial success or freedom to sell the product. International rights require separate planning. We omit those budgets because jurisdictions, translations and filing routes vary greatly.
Public disclosure can affect rights, particularly outside the United States. Do not rely on a general internet description of a grace period to decide when to publish, sell or demonstrate the invention. Keep the disclosure history and technical changes documented and obtain advice suited to the intended markets. The purpose of the budget is to support that decision, not to encourage a filing regardless of business value.
Hypothetical example: a small hardware accessory
Assume an inventor qualifies for micro entity fees and has a relatively simple hardware improvement. A professionally prepared provisional at $1,500 to $3,500 plus the $65 government fee costs $1,565 to $3,565. Later, nonprovisional drafting at $6,000 to $12,000 plus $400 initial government fees costs $6,400 to $12,400 before drawings. These are staged costs, not alternative complete patent prices.
Add drawings at $300 to $800, a hypothetical $1,500 to $5,000 examination reserve and the $258 micro issue fee if allowed. The combined provisional through issue planning total becomes $10,023 to $22,023. It assumes limited response work and excludes maintenance, further applications and disputes. At unchanged micro rates, later maintenance adds $2,894. A more complex invention or more examination work can exceed this range.
Verified ordinary base fees for the hypothetical micro entity example. Drawings and professional work are separate.
What drives the cost up or down
Technical complexity, quality of disclosure, number of inventions, claim count and examination issues are major drivers. Government discounts reduce official charges but do not automatically discount professional work. Filing formats and extra claims can add fees. Poorly scoped cheap drafting can lead to extra revision work, while careful initial preparation still cannot promise allowance.
Costs stay clearer when technical material is organized, deadlines are tracked and proposals separate each stage. Do not buy a full lifecycle promise that never explains examination limits or maintenance. Ask how much revision time is included and what triggers a new quote. A staged budget with honest exclusions is more useful than a precise number presented as the price of any patent.
Frequently asked questions
Is a provisional an issued patent?
No. It is not substantively examined and does not issue by itself. It can support an earlier filing date for adequately disclosed material if the follow on requirements are met. Budget for the next stage rather than treating the provisional as permanent patent protection.
Does every small business qualify for micro fees?
No. Micro status has specific eligibility and certification requirements beyond calling the business a startup. Small and micro status are different categories. Check the current USPTO rules and confirm status when paying fees rather than automatically selecting the lowest amount.
What is the initial nonprovisional government subtotal?
Ordinary base filing, search and examination total $2,000 large or $400 micro. Small entity fees total $800 before the electronic basic filing discount, or $730 when that discounted filing fee applies. Extra claims, format surcharges and other applicable charges can increase the subtotal.
Are attorney responses included in drafting?
Sometimes a package includes limited later work, but many drafting quotes do not. Ask how office actions, interviews and amendments are priced. Our response reserve is a labelled assumption, not a promise that 1 response will complete examination or result in a patent.
Does a trademark calculator estimate patent costs?
No. Trademark registration protects brand identifiers and uses a different fee model. Our trademark calculator is useful for a separate brand budget, not for patent filing. Patent, copyright and trademark costs should be planned independently when a business needs more than 1 type of protection.
